A man died after going overboard while on holiday on a cruise ship following anti-gay remarks, according to his lawyer.

The Royal Caribbean cruise line claims 35-year-old Brazilian Bernardo Albaz committed suicide, saying in a statement: "Our security team responded to the guest's stateroom after a neighbouring guest complained about a domestic dispute... Our staff were unable to prevent his jumping from the stateroom balcony."

But his family's attorney, Michael Winkleman, insists that he did not jump and that it was not suicide

Albaz, who is gay, was travelling with his partner when Winkleman claims they were the targets of anti-gay remarks by the crew.

According to the Daily Mail, Winkleman claimed that before his death, Albaz had an altercation with a member of staff in one of the bars on board.

"There were a number of Royal Caribbean security guards that were actually in the room when this all went down and they were right there on the scene as Bernardo was hanging on for dear life over the side of the ship," Winkleman told Inside Edition.

"This was not a domestic dispute," Winkleman said. "This was an altercation directly implicating Royal Caribbean security that was all based on repeated anti-gay remarks that were made to this couple."

This video, posted on YouTube, appears to show passengers on the ship calling to a man in shorts [Albaz] holding on to a lifeboat support bracket, as the ship moves.

"Because of you, this happened ... Let go of me! Get off of me!" he shouts in English, before seeming to lose his grip and fall into the ocean out of view.

The incident happened on the Oasis of the Seas, one of the world's biggest cruise ships.
