A "peeping Tom" who was caught taking pictures up the skirt of an airline attendant has escaped criminal charges - because prosecutors couldn't determine exactly which part of Japan the plane was flying over at the time of the incident.

The 34-year-old man, who was arrested for his behaviour, admitted accusations that he had taken pictures up the skirt of Japan Airlines attendant on an internal flight, says a report in Japan Daily Press.

He said he extended his hand into the aisle while holding a small, pen-shaped micro camera to take pictures as the stewardess walked past, admitting that he couldn't help himself as he was "aroused by uniforms."

But prosecutors were unable to press charges because they are required by law to state where the crime took place. As the plane was mid-air, they had no concrete evidence to prove which prefecture it had happened. Japan is divided into 47 prefectures or provinces and, although police believe it happened over Hyogo province, this cannot be proven.
